TERMS AND CONDITIONS
WE ARE DELIGHTED TO HAVE YOU JOIN OUR PROGRAM AND PURCHASE YOUR STARTER KIT FOR THE HIGH-PERFORMANCE COACHING ACADEMY. HOWEVER, BEFORE YOU DO, WE ASK THAT YOU READ AND AGREE TO OUR TERMS AND CONDITIONS TO ASSURE A STRONG WORKING RELATIONSHIP.
By purchasing the Center for Executive Coaching High-Performance Coaching Academy Starter Kit, you will receive the following:
Eight (8) Participant’s Manuals, which allows you to get your first group started (and you can always purchase more Participant's Manuals as needed).
Use of two marketing flyers and the right to use your logo on those flyers.
Use of the Center for Executive Coaching logo and name "Center for Executive Coaching’s High-Performance Coaching Academy" on your website and marketing materials.
Participation in our live training. If you miss a training session, we record each one and put them in a member area for anytime access. Also, Andrew Neitlich is available for questions as needed.
Membership in our Linkedin Group to share best practices.
Access to our member area where we store recordings of our trainings.
The right to purchase future Participant Manuals at $295 per manual (plus shipping at our cost with no mark up to you), a savings of $200 compared to the current price.
One-on-one support by email and, when required, by phone.
You also have a 30-day no-questions-asked money-back guarantee. If you are not satisfied by the end of 30 days and don't want to keep your Facilitator's Manual and Participant's Guides after that time, even to hold when the opportunity arises to offer a program to clients or to the public, return them to us (because we pay shipping to you, you pay shipping back to us) and you will get a refund of your Starter Kit investment paid to us.
In exchange, we require you to agree to the following terms:
Non Exclusive/No royalties. You have the non-exclusive right to use the materials described on the website (“materials”) to conduct a High-Performance Coaching Academy as an independent professional. The materials are provided by the Center for Executive Coaching and Andrew Neitlich (referred to herein as “Center for Executive Coaching,” “us” and “we”). With this program, you owe us no ongoing royalties.
Additional Manuals. If and when you choose to purchase additional manuals, there is no minimum order, although you understand that shipping costs per manual decrease the more that you order. You are responsible for placing your order in time for printing and shipping to meet your timeline. Please contact us with any questions. Note that we use an outside vendor for printing and shipping and cannot be responsible for delays outside our control. If you anticipate high demand, please purchase inventory well ahead of time to be sure that you have Participant Manuals when you need them.
Logos. In addition to your rights to use our logos as described above, you may add your logo/company name to the Participant Manual as an adhesive label that you print at your cost and apply to the right of the Center for Executive Coaching logo. This label must be approximately the same size as the Center for Executive Coaching logo. Moreover, if you commit to purchasing an additional 20 manuals up front (after the Starter Kit) and pay our designer for the design cost (at their cost, with no markup to us; about $75-$100 one time), we can print Participant Manuals with your logo on them. You are responsible for shipping costs as per above terms. Contact Andrew Neitlich after purchasing your Starter Kit to make this happen.
One Manual Per Participant. You must purchase one Participant Manual per participant in the programs you offer. Participant Manuals are not transferrable and may not be borrowed/loaned, copied, sold, leased, or in any way transferred from one participant to another. If a participant leaves the program, you may not give their manual to another participant without paying for an additional manual.
Single Seat. The Starter Kit is a “single seat” purchase for one person only that may not be transferred. If you have more than one person who will be offering this program in your firm, they must make a separate purchase of a Starter Kit first so that they can also be trained, and then you can together or individually purchase additional copies of Participant Manuals.
You Handle Logistics and the “How.” You are responsible for all logistics of running programs, including marketing, arranging locations, providing materials, managing participants, staying in touch with participants between sessions, scheduling, graduation logistics, and all follow up before and in between sessions.
Modifications to Printed Manuals. You are prohibited from reprinting the materials in any form or distributing them in any manner. You may not modify, make derivative works, or otherwise change the contents of these materials without written permission from the Center for Executive Coaching. Similarly, no part of the program materials may be adapted, printed, published, reproduced, duplicated, distributed, transmitted, or transferred without written permission from the Center for Executive Coaching. This includes using the materials in or as the basis of a film, video, television or radio program, article, story, brochure, book, or any written published or unpublished work.
Note that, regardless of the above term, you are welcome to be flexible in how you deliver the content. You may make adaptations to number of participants, adjust program length, add assessments, add speakers, add or substitute topics, add case studies, and make other modifications to suit your audience; if in doubt, please ask! Also, if you commit to a significant number of manuals and/or at the request of a significant number of facilitators of the Center for Executive Coaching High-Performance Coaching Academy, we will write additional content for the program. In other words, we are committed to reasonable ongoing development and adaptation of the program so that you are successful.
No Sharing, Reselling, or Training Others. You shall not sell, loan, or lease the materials and shall not permit or sublicense others to do so. You may not train others to use the materials.
If you fail to sell any manuals you may not sell them, nor may you sell your Facilitator's or Participant’s Manuals on sites such as (but not limited to) Ebay, Amazon, or similar online or bricks and mortar stores, or sell them to any other parties.
Other Parties. This agreement in no way creates any other legal relationship between other parties and us, including between your clients and us or between your contractors/employees and us.
You are not an agent, employee, affiliate or otherwise legally connected to the Center for Executive Coaching.
You may advertise that you are licensed to deliver the Center for Executive Coaching’s High-performance Coaching Academy.
Intellectual Property. You understand that the materials you are purchasing constitute a valuable proprietary product of the Center for Executive Coaching embodying substantial creative efforts and confidential information, ideas, and expressions. We are not claiming any kind of title to generic concepts like group trainings, group coaching, assessments, or long-term training and development programs, nor are we restricting your ability to compete in the market with other programs you might offer. However, title to the written and graphic materials provided to you by us remain exclusively with the Center for Executive Coaching and is protected by trademark and copyright law. Should you breach any of our rights under these laws, you understand and agree that our remedies at law may be inadequate and we shall be entitled to equitable relief, including without limitation, injunctive relief, specific performance, or other remedies.
Indemnification. You agree to defend, indemnify and hold the Center for Executive Coaching harmless from any and all claims, demands, liabilities, obligations, costs and expenses of any nature whatsoever arising out of or based upon the use of the materials by you. Should any claims arise and be won by you, damages shall not exceed the cost paid to us by you.
Attorney Fees. We have never been in a lawsuit because we attract great people in our business dealings and we work hard to form strong relationships. We intend to continue this track record. However, in the event that we must engage an attorney to enforce our rights under these terms, we shall be entitled to recover reasonable attorney fees.
Payment. If you choose to make payment via installments, you agree that these payments are not a subscription that you can cancel. Rather, you are committing to a payment plan with a start and stop date and you agree to make all payments. You may not use our materials if you are not in compliance with payments.
Due Diligence. You understand and acknowledge that this is a competitive business and we have not made any earnings claims. You have done your due diligence about competitors, financial projections, and legal requirements in your area and take full responsibility for the results you achieve.
Florida Law. This agreement shall be governed by the laws of Florida.
No Assignation. You shall not sell, assign, or sublicense any of the rights, authorizations, or permission granted herein.
Entire Agreement. This agreement constitutes the entire agreement between us.
We are recognized by SHRM to offer Professional Development Credits (PDCs) for the SHRM-CPSM or SHRM-SCPSM
This program has been approved for (General) recertification credit hours toward PHR, SPHR and GPHR recertification through the HR Certification Institute. You can get up to 60 credit hours through our live training as you go through our program.
The use of this seal is not an endorsement by the HR Certification Institute of the quality of the program. It means that this program has met the HR Certification Institute's criteria to be pre-approved for recertification credit.
